Bush Administration Policy on Federal Preemption of State Regulations Reversed
Obama memorandum issued.
In a memorandum issued May 20, the Obama administration directed executive departments and agencies to review any preemptive regulations and preambles issued in the last 10 years to make sure that they are not overrriding more aggressive health, safety, and environmental policies enacted by the various states unless there is a compelling legal reason for the federal government to do so.
"Executive departments and agencies cannot announce that their regulations preempt state law, including State common law, without explicit preemption by Congress or an otherwise sufficient basis under applicable legal principles," President Obama said.
