Solvent Tax Provision Defeated

A little known provision in the 2005 Energy Bill would have imposed excise taxes of up to 24 cents per gallon on mineral spirits, toluene, xylene, and several other solvents commonly used in the protective coatings industry. This measure was defeated by joint efforts of the National Paint and Coatings Association and the American Chemical Council. The two associations successfully argued that there is no viable evidence of solvent fraud-the illegal blending of chemical products sold to industrial users with taxable fuels-according to a 2004 Treasury Department report. The defeat of the solvents tax provision saves industrial users $100 million in fees per year.
