Penalty Box: Ohio paint manufacturer contests OSHA citation
An Ohio paint manufacturer is contesting a willful citation and
a fine of $87,500 due to the alleged violation of two OSHA rules:
- failure to use personal equipment whenever hazards capable
of causing injury and impairment are encountered (29 CFR 1910.132(a)),
and
- failure to use approved power-operated industrial trucks designated
as EX in atmospheres containing gases in qualities which could
produce explosive or ignitable mixtures and where such concentrations
of gases or vapors exist continuously, intermittently or periodically
under normal operating conditions or may exist frequently because
of repair, maintenance operations, leakage, breakdown or faulty
operation of equipment (29 CFR 1910.178(c)(2)
